Terms & Conditions – Franklin Skip Bins

  1. Introduction
  2. These terms and conditions ("Agreement") govern the use of skip bin hire services provided by Franklin Skip Bins ("Company") to the customer ("Customer"). By accessing or using our services, the Customer agrees to be bound by this Agreement.

  3. Pricing
  4. The pricing for skip bin hire services is based on the size of the skip bin, the weight of the bin, the duration of the hire period, and the location of the delivery.All prices quoted by the Company are in New Zealand Dollars and are inclusive of applicable taxes, unless otherwise specified.The Customer agrees to pay the total agreed price for the skip bin hire, as specified in the Company's quotation or invoice.Additional charges may apply for extra services, including but not limited to excess weight, extended hire periods, and removal of prohibited items.

  5. Additional Charges
  6. Once the weight exceeds the weight listed, there will be an additional charge of 30c per kg.

  7. Payments
  8. The Customer must make full payment for the skip bin hire prior to or upon delivery, unless otherwise agreed in writing with the Company.Payment can be made by an internet banking transfer or by cash.In the event of late payment, the Company reserves the right to charge late fees, suspend services, or initiate legal proceedings to recover outstanding amounts.

  9. Prohibited Items
  10. The Customer must not place any hazardous, toxic, flammable, or dangerous materials in the skip bin, including but not limited to asbestos, chemicals, paint, batteries, gas cylinders, and explosives.If prohibited items are found in the skip bin, the Company may refuse collection and may charge the Customer for any additional costs incurred.The Customer is solely responsible for the contents of the skip bin and must comply with all relevant laws and regulations regarding waste disposal.

  11. Site Access
  12. The Customer must ensure that there is clear and unobstructed access to the delivery and collection site for the skip bin.If the Company is unable to access the site due to obstacles or unsafe conditions, the Customer may be charged for additional costs or a failed delivery/collection fee.The Customer is responsible for obtaining any necessary permits or permissions required for the placement of the skip bin, including parking permits and council approvals.

  13. Remote Locations
  14. The Company reserves the right to refuse skip bin hire services to remote locations that are not within its regular service area.If the Customer's location is considered remote, the Company may apply additional charges to cover the cost of transportation and logistics.The Company will inform the Customer of any remote location surcharges prior to accepting the booking.

    With surrounding areas there is a standard charge for pick up of the bins.

  15. Liability and Indemnity
  16. The Customer agrees to indemnify and hold the Company, its employees, and agents harmless from any claims, liabilities, damages, or expenses arising from the Customer's use of the skip bin hire services, including but not limited to personal injury, property damage, and violation of laws or regulations.The Company will not be liable for any loss, damage, or injury arising from the Customer's misuse, overloading, or negligent handling of the skip bin.The skip bin must be returned in the same condition as it is delivered in. The Customer is liable for any damage inflicted to the skip bin, including but not limited to damage by machinery or vehicle.

  17. Termination/Cancellation
  18. Either party may cancel a booking, thus terminating this Agreement, by providing written notice to the other party prior to the scheduled booking time. The Company reserves the right to terminate or suspend services immediately if the Customer breaches any provision of this Agreement.

  19. Governing Law and Jurisdiction
  20. This Agreement shall be governed by and interpreted in accordance with the laws of New Zealand. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in New Zealand.

  21. Entire Agreement
  22. This Agreement constitutes the entire understanding between the Customer and the Company and supersedes all prior agreements, understandings, or representations, whether oral or written.

    By engaging in our skip bin hire services, the Customer acknowledges and agrees to be bound by these terms and conditions.
